Terms of Service

1) Acceptance

These Terms of Service (the “Terms”) govern your access to and use of the websites, products, and services provided by Mazzaroth Labs LLC (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you are using the Services on behalf of an entity, you represent that you are authorized to bind that entity, and “you” refers to that entity.

2) Changes to Terms

We may modify these Terms from time to time. The “Effective” date reflects the latest update. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

3) Eligibility

You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Services. If you are under the age of majority, you may use the Services only with the involvement of a parent or guardian.

4) Our Services

Mazzaroth Labs LLC designs and delivers custom software solutions and creates software and hardware for amateur radio operators. Features and functionality may evolve. We may suspend or terminate features to maintain security, availability, or compliance.

5) SMS/Text Messaging Terms

We may offer optional SMS/text messaging for account notices, service notifications, or marketing updates.

• Consent: By providing your mobile number and opting in, you consent to receive recurring automated and/or manual text messages from Mazzaroth Labs at the number you provided. Consent is not a condition of purchase.
• Opt-In Methods: Web forms, account settings, or texting a published keyword to our long code/short code (when available).
• Opt-Out: Reply STOP to cancel. After you send STOP, we may send a final message to confirm your opt-out. You can also email support@mazzarothlabs.com for assistance.
• Help: Reply HELP for help or email support@mazzarothlabs.com.
• Frequency: Message frequency varies by user and program. We strive to keep messaging purposeful and limited.
• Costs: Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
• Eligibility: Only users in supported regions and carriers may receive messages. Delivery depends on your carrier network.
• Data Use: We process your phone number and messaging metadata to provide the program and maintain opt-in/opt-out records. See our Privacy Policy for details.
• Prohibited Use: Do not use any messaging feature to send unlawful, unsolicited, or harmful content.

6) Accounts and Security

You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly of any unauthorized access or security incident.

7) Acceptable Use

• Do not interfere with the normal operation of the Services or attempt to access them using methods other than the interface we provide.
• Do not upload or transmit malicious code, abusive content, or material that infringes intellectual property or privacy rights.
• Comply with all applicable laws, regulations, and technical standards, including radio regulations (e.g., FCC Part 97 in the U.S.).

8) Amateur Radio and Engineering Disclaimers

• Our hardware and software may require appropriate licensing and operator skill. Always follow local regulations and safety practices.
• Engineering samples and prototypes may not be certified for commercial use and are provided for evaluation or experimental use only.
• You are responsible for ensuring your station or system operates within legal limits and does not cause harmful interference.

9) Intellectual Property

We and our licensors own all rights, title, and interest in the Services and content, including software, documentation, logos, and trademarks. These Terms do not grant you any rights to our intellectual property except as expressly permitted in writing.

10) Feedback

If you provide feedback, ideas, or suggestions, you grant us a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, copy, modify, and commercialize the feedback.

11) Third-Party Services

The Services may interoperate with third-party services (e.g., communications providers). We are not responsible for third-party services, their availability, or their terms.

12) Warranty Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ANY MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAZZAROTH LABS LLC AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

14) Indemnification

You will defend, indemnify, and hold harmless Mazzaroth Labs LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or violation of these Terms.

15) Export and Sanctions

You must comply with U.S. and other applicable export control and sanctions laws. You agree not to export or re-export the Services or related technology in violation of such laws.

16) Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Georgia, USA, without regard to conflicts of law principles. The exclusive venue for any dispute shall be the state and federal courts located in Jackson County, Georgia. You and Mazzaroth Labs consent to personal jurisdiction in those courts.

17) Termination

We may suspend or terminate your access to the Services at any time for any reason, including if you violate these Terms. Upon termination, your right to use the Services ceases immediately.
